General terms and conditions
1. General Provisions
These General Terms and Conditions apply to contracts, deliveries and other services provided by SC-International AG (hereinafter also referred to as “SCI”) to all customers (private customers, end customers, beauty therapists, etc.). Any deviations from these terms require SCI’s express written consent. SCI is entitled to amend or supplement these terms. These General Terms and Conditions take effect on 1 January 2026 and replace all SCI General Terms and Conditions valid before that date.
2. Offers
Our offers are non-binding. Orders are binding on us only to the extent that we confirm them or fulfil them by dispatching the goods. Verbal supplementary agreements are valid only if confirmed by us in writing. Third-party intellectual property rights must be respected when using the goods supplied. Variations due to printing and technical changes are possible.
3. Prices
The prices valid on the date of delivery shall always apply for invoicing purposes. If these are higher than the prices at the time the contract was concluded, the customer is entitled to withdraw from the contract in respect of quantities not yet accepted within eight days of being notified of the price increase. Prices are stated in Swiss francs and exclude VAT. Prices are subject to change. Where delivery to the customer's premises free of freight charges has been agreed, our quoted prices are based on the freight rates and ancillary charges applicable at the time of the offer. If freight rates or ancillary charges change, our delivery prices will be adjusted in favour of or to the detriment of the seller, without giving the buyer a right to withdraw from the contract.
4. Payment Terms
Devices and initial supplies must be paid for in advance. As a general rule, orders are payable in advance. By prior arrangement with us, invoices may be paid within 30 days of the invoice date without deduction and free of postage costs or other charges to us. In the event of late payment, default interest of 10% per annum shall apply, and reminder fees of CHF 10.00 will be charged, increasing to CHF 20.00 from the third reminder onwards.
5. Delivery
The flat-rate shipping charge within Switzerland is CHF 12.00. No shipping charges apply to orders with a net value exceeding CHF 300.00. No shipping charges apply to subsequent deliveries of outstanding items. Loading and shipping are uninsured and at the recipient's own risk. In all other respects, the General Terms and Conditions of the carrier “Liechtensteinische Post AG” apply / www.post.li. Our obligation to deliver is suspended for as long as the buyer is in arrears with any payment obligation. If an agreed delivery deadline is exceeded for reasons attributable to us, we shall be in default only after a reasonable additional period has been set and has expired.
6. Training and Courses
Courses are conducted in cooperation with Beauty Cosmetics GmbH.
Registration for our educational programmes, courses, training sessions and workshops becomes binding upon written confirmation by SCI. Course invoices are issued by Beauty Cosmetics GmbH and must be paid no later than 30 days before the course starts; otherwise, participation cannot be guaranteed. Cancellations must be submitted properly and in writing and are possible only under the following conditions:
Between 30 and 40 days before the course starts, a partial refund of 50% of the course, event or lecture fees is available in the form of a credit. If cancellation is submitted in writing due to illness or an accident, a medical certificate must be provided to obtain this refund. The refund is credited to your customer account and may be used to attend another training session or the next available session of the same course. This option is no longer available 29 days or fewer before the course starts. Course fees will not be refunded in the event of illness or an accident; participants are responsible for arranging their own insurance to cover these costs.
SCI reserves the right to cancel or postpone a planned or ongoing course provided by Beauty Cosmetics GmbH for organisational or other reasons. Additional costs arising from cancellation (e.g. hotel or travel expenses) will not be reimbursed.
7. Statutory Warranty
All information regarding the suitability, processing and use of our products, technical advice and other information is provided to the best of our knowledge but does not release the buyer from carrying out their own inspections and tests. Upon receipt, the buyer must immediately inspect the goods for defects relating to their condition and intended use, including a processing trial where reasonably practicable; otherwise, the goods shall be deemed accepted. Complaints will be considered only if submitted in writing with supporting documentation within eight days of receipt of the goods or, in the case of hidden defects, within eight days of their discovery, but in any event no later than six months after receipt of the goods. Goods subject to a complaint may be returned only with our express consent. Our statutory warranty obligations are limited, at our discretion, to replacement delivery, rescission, a price reduction or repair. Swiss Color pigments are excluded from any right of return, even if the packaging is unopened. The statutory warranty period for rechargeable batteries and battery packs is six (6) months from delivery. Rechargeable batteries are considered wear parts. Warranty coverage applies exclusively to proven manufacturing or material defects. In particular, natural loss of capacity and wear resulting from use, charging cycles, storage or improper handling are expressly excluded from warranty coverage.
8. Guarantee
SCI provides a two-year guarantee on all devices and handpieces. The customer shall bear the cost of repairs to products whose guarantee has expired. During the repair process, SCI will provide a replacement device or handpiece at the customer's request. The customer must return the replacement device or handpiece to SCI after receiving the repaired product. Compensation will be payable if the replacement device or handpiece is damaged or not returned. Events of force majeure, meaning circumstances and events that cannot be prevented through the exercise of due care in the proper management of a business, suspend the parties' contractual obligations for the duration of the disruption and to the extent of its effects. If the resulting delays exceed six weeks, either party is entitled to withdraw from the contract in respect of the affected obligations. No other claims shall arise.
9. Damages
To the extent permitted by law, our liability for damages, irrespective of the legal basis, is limited to the invoice value of the quantity of our goods directly involved in the event giving rise to the damage. This does not apply where mandatory statutory provisions impose unlimited liability on us for intent or gross negligence. Buyers acknowledge that the use of certain Swiss Color devices and handpieces requires specific hygiene modules. The availability of these hygiene modules may vary depending on the manufacturer and market conditions. SCI accepts no responsibility for any difficulties or inconvenience arising from the unavailability of consumables. For events, Swiss Color, as the organiser, reserves the right to replace announced speakers who are unable to attend with equivalent speakers or programme items, including at short notice. No entitlement to a price reduction or refund arises in such cases.
10. Retention of Title
The goods remain the property of SCI until paid for in full. In the event of late payment, we are entitled to withdraw from the purchase contract. The buyer must notify us immediately by registered letter of any third-party attachment of or other action against goods or receivables belonging to us. Exercising retention of title does not constitute withdrawal from the contract. Until our claims have been paid in full, neither the goods nor any receivables replacing them may be pledged to third parties, transferred as security or assigned.
11. Data Protection
We undertake to treat your data confidentially in accordance with the Swiss Federal Act on Data Protection (FADP) and not to disclose it to third parties without your consent. In the event of cross-border data exchange, your data will also be processed and stored in accordance with the GDPR, which applies throughout the EU.
12. Place of Performance and Jurisdiction
The place of performance for delivery is the respective place from which the goods are dispatched. Swiss law shall apply. The District Court of St. Gallen (BG St. Gallen) shall be the agreed court of jurisdiction for all legal disputes arising from the contractual relationship.
